Supreme Court Justice Samuel Alito recently disclosed that he has lost friendships over his judicial decisions. He emphasized the courage needed to overturn Roe v. Wade, a decision with significant repercussions. Appointed by President George W. Bush, Alito is known for his conservative stance. In an interview with CBS News, he also expressed concerns about criticism from Presidents Joe Biden and Donald Trump.
The Impact of the Dobbs Decision
Alito authored the majority opinion in Dobbs v. Jackson Women’s Health Organization, which reversed the federal constitutional right to abortion. This decision will likely define his tenure on the Supreme Court. Before its official release, the opinion was leaked, and Alito noted that conservative justices faced unexpected consequences in proceeding with it.
Alito argued that the Constitution does not reference abortion, leaving regulation to the people. This view was criticized by Democrats and advocates of reproductive rights as overturning nearly 50 years of legal precedent. Michele Goodwin, a Georgetown professor, highlighted the irony in abandoning longstanding legal precedents.
“Across 50 years, not just one decision like Roe v. Wade, but nearly a dozen cases defended reproductive rights,” Goodwin stated.
Alito’s Views on Political Criticism
Justice Alito addressed the harsh criticism from political leaders, including assertions that justices serve partisan interests. He noted a significant shift in presidential criticisms, making a bipartisan comparison between Biden and Trump’s rhetoric.
The justice acknowledged the increased threats faced by the judiciary, citing statements from Gabe Roth, director of Fix the Court, and Justice Amy Coney Barrett’s experience with threats following the Dobbs decision.
Decision Against Retirement
Although there were reports of Alito considering retirement, he chose to remain on the bench. He reflected on his contribution to the court and acknowledged the uncertainty surrounding his future decisions.
He indicated that nearing the end of his career, annual reflection on his role and health would be necessary.
A Rare Insight into Supreme Court Justices
Alito’s interview is notable due to the rarity of public insights from Supreme Court justices beyond legal opinions. Growing criticism and threats have impacted public perception of the Court. Gallup’s survey indicates declining approval of the judiciary.
Goodwin suggested that dissatisfaction stems from perceptions of civil and voting rights being dismantled, reflecting a disconnect between the Court and the public.
