A Canadian tourist was found guilty of animal cruelty after a disturbing incident at a Las Vegas Strip hotel. On Monday, prosecutors argued that the tourist, Mitchell Fairbarn from Ontario, injured a flamingo during a bizarre encounter.
The court convicted Fairbarn on felony and misdemeanor animal cruelty charges. The incident took place on March 3 at the Flamingo Las Vegas Hotel and Casino. Fairbarn removed a 27-year-old Chilean flamingo named Peachy from its enclosure and brought it to his hotel room.
Surveillance footage showed Fairbarn holding the flamingo inside an elevator and carrying it through a hallway. He faces four felony counts following accusations of removing Peachy from the resort’s wildlife habitat.
Prosecutors presented evidence showing Fairbarn pulling Peachy by its feet and feathers scattered on the hotel floor. Hotel security reported the missing flamingo, prompting police action. Authorities found the bird missing several feathers, with blood on them, and injuries to its wings.
Tiffany Moore, medical director at Lone Mountain Animal Hospital, reported Peachy is physically well but remains anxious during vet exams.
Fairbarn’s defense attorney, Josh Tomsheck, admitted his client’s poor decisions while intoxicated. “He shouldn’t have done it, and he realizes his mistakes,” Tomsheck noted, emphasizing Fairbarn’s state of intoxication during the incident.
The consequences for Fairbarn have been significant. He remains under house arrest, awaiting sentencing in December. If convicted, he faces up to four years in prison on the felony charge and an additional six months for the misdemeanor.
Fairbarn testified during the trial, acknowledging the severe repercussions of his actions, including receiving death threats and being unable to return to Canada during family emergencies.
Clark County prosecutor Haley Willming stressed that Fairbarn’s choices led to these outcomes. “His own actions caused these consequences,” Willming argued.
The Flamingo Las Vegas, one of the Strip’s older resorts, is renowned for its wildlife habitat, which houses diverse animals, including flamingos, turtles, and koi fish.
