Potential Contempt Vote for Fauci in Senate Committee

Anthony Fauci, the former director of the National Institute of Allergy and Infectious Diseases, faces a contempt-of-Congress vote on Thursday. The Senate Homeland Security and Governmental Affairs Committee, led by Republicans, is considering this move after Fauci declined to answer their questions during a recent hearing, citing his Fifth Amendment rights.

In his opening remarks, Fauci expressed concerns over what he described as Sen. Rand Paul’s “unhinged obsession” with him. Fauci suggested the hearing was an attempt to entrap him into perjuring himself. “Although it pains me to do so because of the respect I have for the legislative branch of government and my decades-long record of cooperating with Congress,” Fauci said, “under the advice of my attorneys, I will invoke my right under the Fifth Amendment of the Constitution to refrain from answering your questions.” He noted that he had already addressed many of their questions in previous testimonies.

The tension between Fauci and Sen. Paul has been ongoing, particularly regarding the origins of the COVID-19 pandemic. In a move that heightened this tension, Paul shared over 1,000 pages of Fauci’s private diary entries before the hearing, claiming they revealed Fauci’s private uncertainty about the pandemic’s origins.

Paul, during the hearing, argued that Fauci should not fear testifying due to a pardon from President Joe Biden. This pardon protects Fauci from prosecution for actions taken between 2014 and January 2025, described by Biden as “preemptive” amid Republican scrutiny. However, this pardon does not shield Fauci from actions taken or statements made beyond that period, including his current congressional testimony.

If Republicans proceed with the contempt vote, the Justice Department must decide on whether to pursue criminal charges. Historcially, such prosecutions are rare, but instances like Steve Bannon and Peter Navarro’s imprisonments on similar charges serve as a precedent. Many Democrats express concern for Fauci, drawing parallels to past prosecutions of former government officials like James Comey, who also faced scrutiny from President Trump.
