Judge Dismisses Murder Charge Against Arkansas Sheriff Nominee

A judge has dismissed a murder charge against Aaron Spencer, a Republican candidate for the position of sheriff in Lonoke County, Arkansas. Spencer had been accused of shooting a man who allegedly sexually assaulted his daughter. The dismissal comes as law enforcement officials were found to have engaged in misconduct, according to the judge.

The charge against Spencer stemmed from the death of Michael Fosler, who had been accused of sexually assaulting Spencer’s 13-year-old daughter. Judge Ralph Wilson Jr. decided to dismiss the second-degree murder charge because crucial dashboard camera footage of the incident had been lost by law enforcement. This loss of evidence was deemed to violate Spencer’s right to due process.

“The Court finds that conduct by law enforcement was so egregious that dismissal of this case is warranted,” Judge Wilson wrote in his order.

Spencer admitted to the shooting, saying he encountered Fosler with his daughter in a car. His daughter had gone missing from her bedroom on October 8, 2024, about a month after Fosler had been charged with sexual assault. When Spencer found them, he claimed that his daughter attempted to leave the car but was restrained by Fosler, prompting Spencer to open fire.

Spencer had pleaded not guilty to the murder charge, arguing his actions were in defense of his daughter. However, state prosecutors alleged that the shooting was premeditated, suggesting Spencer should have contacted law enforcement instead of taking matters into his own hands.
