Texas Man Accused of Murder Faces Extradition Challenges

Texas criminal attorney Dick DeGuerin, who has practiced law for six decades, is currently representing Lee Gilley. Gilley, aged 39, is accused of murdering his pregnant wife, Christa Bauer Gilley, in their Houston home in October 2024. Christa, aged 38, was nine months pregnant at the time.

Prosecutors allege that Gilley, who is charged with capital murder, cut off his ankle monitor and fled to Italy in May, just weeks before his trial was due to commence. DeGuerin noted that in his long tenure as a criminal defense lawyer, he has rarely seen a case where a defendant skips bond in such a manner.

Upon arrival in Italy, Italian authorities detained Gilley, and he has been held in a Turin jail. Initially, the U.S. government attempted to extradite Gilley back to face charges, but Italian courts blocked the process due to the potential for a death penalty sentence.

According to DeGuerin, “The Italian courts will not extradite if the death penalty is on the table, and the charge against Mr. Gilley is capital murder. In Texas, there are only two punishments for capital murder: death or life without the possibility of parole.” On September 18, Harris County prosecutors dropped the death penalty after Italy demanded written guarantees.

DeGuerin explained that Italy requires assurance that the death penalty is not considered, although “We never thought that was on the table anyway,” he acknowledged. The process remains stalled, as Italian courts worry that a judge could overturn assurances and impose the death penalty. DeGuerin clarified, “The answer to that clearly is no. Only a jury can do that.”

Additionally, Italy might refuse extradition if there is a chance Gilley could receive a life sentence without the possibility of parole. The U.S. faces a deadline of September 30 to comply with Italy’s requests for clarification, with a status conference scheduled for October 7 to assess Italy’s stance on extradition.

“We’ve maintained from the very beginning that he is not guilty and he did not kill his wife,” DeGuerin stated confidently.
