Supreme Court Backs States on Transgender Athlete Policies

Former President Donald Trump praised a Supreme Court decision regarding transgender athletes, calling it a “big win.” The Court’s 6-3 ruling favored West Virginia and Idaho, denying trans athletes’ lawsuits seeking access to girls’ sports.

Trump’s celebration followed his previous action of signing an executive order that barred transgender female athletes from participating in women’s or girls’ sporting events. The Supreme Court’s decision emphasized the power of states to determine eligibility norms for women’s sports teams based on biological sex, aligning with Title IX and the Equal Protection Clause.

Justice Sonia Sotomayor wrote an opinion that partially agreed and partially disagreed with the judgment. Justices Elena Kagan and Ketanji Brown Jackson joined Sotomayor, with Jackson also offering a concurrent opinion. The ruling permits states to implement rules safeguarding women’s sports for biological females, protecting the rights that states can hold to enforce such decisions.

The ruling signals a shift, as more than half of the U.S. states now have the capacity to protect women’s sports without the threat of legal challenges. However, 23 states remain without specific laws, some of which allow trans athletes in girls’ sports.

Trump’s “No Men In Women’s Sports” executive order enforced more strictures on transgender athletes, leading to disputes with officials like Maine Gov. Janet Mills. Trump’s administration had attempted to withhold federal funding from non-compliant states, a move struck down by a federal judge in Maine. With this Supreme Court decision, states now have backing against such challenges.

Education Secretary Linda McMahon released a statement celebrating the decision, asserting that it reinforced states’ rights to maintain the integrity of female sports. McMahon criticized the prior interpretations of Title IX, which she claimed harmed female athletes. The Trump Administration, she noted, worked to re-establish Title IX protections for women, and the recent ruling solidifies these efforts.

Surveys indicate that about 80% of Americans are opposed to biological males competing against females in sports. This decision may reflect public sentiments on the issue.
