Federal Judge Orders Release of Salah Sarsour from ICE Detention

A federal judge appointed by President Donald Trump has ordered the release of Salah Sarsour, president of the Islamic Society of Milwaukee, from U.S. Immigration and Customs Enforcement (ICE) detention. This decision comes after Sarsour spent three months in custody. U.S. District Judge James Patrick Hanlon ruled on the case, highlighting a potential First Amendment retaliation claim that questions the legality of Sarsour’s detention.

Sarsour’s Background

Sarsour has held a green card for close to 30 years. However, the Department of Homeland Security (DHS) accused him of falsifying information on his application in 1998. Hanlon expressed skepticism over the timing of enforcement against Sarsour, given his longstanding status as a lawful resident.

Upon his release, Sarsour was greeted by hundreds outside the Islamic Society of Milwaukee. Addressing the crowd, he expressed gratitude and a commitment to serve his community.

Background Allegations

In 1993, Sarsour applied for a visa at the American Consulate in Jerusalem, but it was denied due to allegations of past criminal activities. Despite these accusations, he later entered the U.S. as a conditional resident. DHS believes he misrepresented facts on his green card application five years later.

Sarsour has been a longtime resident of Wisconsin. The Islamic Society praised his contributions to the community, noting his role in hiring local residents and advocating for immigrant and Palestinian rights.

Judge’s Ruling

The court found that Sarsour’s speech, particularly his advocacy for Palestinian rights, falls under protected political speech. According to the judge, this protection extends to noncitizens living in the U.S.
