On Monday, Massachusetts Governor Maura Healey signed a new law granting doctors the authority to determine the permissibility of late-term abortions. This legislative change positions Massachusetts as the tenth state to permit abortions at any stage of pregnancy.
The Prioritizing Patient Access to Care Act eliminates the previous legal restrictions on abortions beyond 24 weeks of pregnancy. Formerly, the law allowed such procedures only under specific conditions, including the necessity to protect the patient’s life or health, or due to a lethal fetal anomaly. Under the new law, abortions are permitted based solely on a physician’s professional judgment.
Governor Healey expressed the importance of the law by recounting stories from women who faced heartbreaking situations late in their pregnancies. She noted that some families, expecting to welcome a healthy baby, received devastating news and were compelled to travel long distances and incur significant expenses for medical care not available at home. According to Healey, this legislation ensures such scenarios are avoidable in Massachusetts.
Healey emphasized that health care decisions should be made between women and their doctors, which aligns with Massachusetts’ goal of maintaining robust abortion protections. The new legislation reflects the state’s commitment to prioritizing women’s autonomy and healthcare rights.
According to KFF, a nonprofit research organization specializing in health policy, Massachusetts joins nine other states and Washington, D.C., in having no gestational abortion limits. The other states with similar policies are Alaska, Colorado, Maryland, Michigan, Minnesota, New Jersey, New Mexico, Oregon, and Vermont.
