Merit-Based Overhaul of Federal Hiring Under Trump’s OPM

The Trump administration has taken steps to transform federal hiring by focusing on merit rather than diversity, equity, and inclusion (DEI) initiatives. Scott Kupor, Director of the Office of Personnel Management (OPM), has detailed these changes aimed at improving accountability and performance across the federal workforce of 2.2 million employees.

Eliminating DEI Practices

To align with its agenda, the administration has removed certain DEI policies. A final interim rule issued by OPM eliminates references to the 1978 Uniform Guidelines on Employee Selection Procedures, based on a Justice Department opinion deeming them unconstitutional due to race-conscious decision-making encouragement. This change affects hiring practices by discarding guidance related to ‘disparate impact,’ which considered outcomes across racial groups.

A Focus on Merit

Kupor emphasized that federal hiring should center on merit and qualifications. The new rule intends to maintain job-related standards, ensuring agencies hire the most qualified individuals. It allows for public comment over a 60-day period before a permanent decision is made.

Wider Impact and Criticism

This overhaul is part of broader efforts by the administration to curb DEI initiatives, extend beyond DEI offices, and challenge existing legal and regulatory frameworks. It involves changes in policies at educational institutions, especially focusing on race-conscious programs and merit-based admissions.

Since the start of President Trump’s second term, there has been significant attention on institutions altering DEI efforts. Additionally, federal DEI programs have been dismantled, related grants terminated, and compliance demanded from federal contractors.

These reforms reflect the administration’s goal to reinforce a merit-based federal workforce, significantly reducing the emphasis on race-based decision-making in hiring practices.
