Trial Set for Former FBI Director James Comey Over Seashell Photo

Former FBI Director James Comey is scheduled to face trial on October 21, focusing on a photo of seashells he posted on Instagram. The trial will proceed if the Trump administration’s case against him withstands expected legal challenges. The U.S. District Judge Louise Flanagan announced the trial date on Tuesday.

The controversy centers around a seashell image arranged to form “8647.” A federal grand jury in North Carolina indicted Comey in April, claiming the image conveyed a threat to harm President Trump. Notably, “86” is common restaurant terminology for an item that is out of stock or removed from the menu.

Comey’s legal team plans to file motions to dismiss, citing reasons including vindictive and selective prosecution. Judge Flanagan acknowledged these plans in her order. If the case proceeds, Comey will have an arraignment on September 30 at the federal courthouse in New Bern, North Carolina.

Previously, Comey’s team successfully defended against a similar federal case in Virginia. There, a judge decided against Lindsey Halligan, a supporter of Trump, due to her improper appointment when addressing a federal grand jury.

This situation is not isolated, as the Trump administration has encountered multiple obstacles with federal grand juries. These include a situation in Washington where a grand jury declined to indict six Democratic lawmakers for a social media video. Recently, a federal judge in Chicago criticized the actions of the U.S. Attorney’s Office for the Northern District of Illinois in a case involving anti-ICE protesters, where prosecutors were accused of improperly swaying the grand jury.

Pretrial motions in Comey’s case are due on July 28, with responses to those motions expected by August 18. The deadline for replies to pretrial motions is September 1.
