Justice Elena Kagan Expresses Condolences for Late Senator Lindsey Graham

Supreme Court Justice Elena Kagan addressed the House Appropriations Committee, beginning her testimony by extending condolences for the death of Senator Lindsey Graham, R-Ky. Graham, who passed away due to a ruptured aorta, was commemorated by Kagan for his influence during her confirmation to the Supreme Court.

Kagan emphasized the bipartisan significance of Graham’s support during her nomination process in 2010. Among the Senate Republicans, Graham was one of five who voted in favor of her appointment by then-President Barack Obama. Such cross-party support is rare and noteworthy as confirmation votes have increasingly split along party lines.

“Not many Republicans vote for nominees selected by a Democratic president, nor do many Democrats do the same for Republican-selected nominees,” Kagan stated. “Yet, Senator Graham voted for me despite political divides.”

Reflecting on her interactions with Graham, Kagan recalled a memorable conversation held in his office before her hearing. Though she did not know him well, she recounted his vivid personality and humor, referencing Senator Al Franken’s remark that Graham was the funniest man in the Senate. A humorous exchange during her hearing about what Kagan, who is Jewish, did on Christmas sealed her confirmation, according to many observers.

Kagan shared her appreciation for Graham’s seriousness and respect during her confirmation process, highlighting his 23-year Senate career and his earlier service in the House of Representatives. Graham, aged 71, was succeeded by his sister, Darline Graham, appointed by South Carolina Governor Henry McMaster to complete his term ending in January 2027.
