James Talarico’s Past Remarks on Gender Identity and Child Abuse Draw Scrutiny

James Talarico, the Democratic candidate for U.S. Senate in Texas, faced renewed attention over past comments concerning parental recognition of children’s gender identity. Talarico once suggested that denying a child’s gender identity may constitute “abusive” behavior. He made these remarks during a 2019 Texas Legislature committee hearing.

These comments present a challenge as Talarico seeks to position himself as a moderate on various issues including gender, policing, and border security in a state traditionally leaning Republican. Talarico has since stated he ‘missed the mark’ on what some label as woke statements.

During the 2026 campaign, Talarico addressed a crowd at the Cailloux Theater in Kerrville, Texas, as he campaigned against Republican candidate Ken Paxton. The race gains attention as the November 3 election approaches.

“I think there are some folks that would think if you deny your child’s gender identity, that’s incredibly harmful,” Talarico remarked. “Whether or not we label it with the term abuse, it’s certainly abuse for sure.”

At the time, Talarico spoke against HB 1910, a bill aimed to ensure that parental refusal to affirm their child’s gender identity would not amount to child abuse in custody cases. Talarico worried that categorically excluding such refusal from abuse considerations might harm vulnerable children in Texas.

In a related debate, Talarico expressed concern over classifying refusal to recognize a child’s gender identity entirely free from the prospect of being abusive.

“My concern is ruling it out as not being abuse,” Talarico stated, “I think is dangerous and could harm some of our most vulnerable kids in the state.”

Other critics, including a spokesperson for the Republican National Committee, harshly condemned Talarico’s position. Despite the controversy, a revised and more stringent version of the bill passed the Texas House in May 2025 and became law.

Talarico also voted against this stronger version and supported an amendment asserting that rejecting a child’s gender identity constitutes abuse under Texas law.

When reflecting on his statements, the Talarico campaign supported parental rights. A campaign spokesperson emphasized Talarico’s belief in parental decision-making authority.

“James believes parents have the most important say in decisions about their children,” said JT Ennis, a spokesperson for the Talarico campaign. “He has fought for Texas parents and families.”
