Federal Judge Halts Trump’s Migrant Fines Over Legal Violations

A federal judge has halted the Trump administration’s efforts to impose fines of up to $1.8 million on migrants who did not leave the country after receiving deportation orders. This decision was made by U.S. District Judge George O’Toole in Boston, following a class-action lawsuit filed by two migrants facing such penalties. The judge determined the process used to impose the fines violated federal law, potentially pushing migrants into financial ruin.

In his ruling, Judge O’Toole highlighted the economic struggles that plaintiffs faced even before the fines were imposed. He noted that the penalties, if enforced, could lead to severe financial consequences such as wage garnishment, asset loss, and federal lawsuits. He stressed that simply removing the fines would not necessarily resolve the issues or restore their previous situation.

Appointed by former President Bill Clinton, O’Toole described the plaintiffs as individuals who work low-paying jobs and fled political violence. One plaintiff, referred to as Nancy M., faced a fine over $1.8 million. She works over 60 hours a week at two jobs and experiences severe anxiety due to the situation.

The judge found that the Trump administration’s fine notices violated the Administrative Procedure Act by not providing clear reasons for the penalties. The fines were deemed unlawful, with a potential to drive migrants into insolvency.

The Department of Homeland Security (DHS) defended the fines, citing that migrants failing to leave after a final deportation order could be fined $998 daily. The fines were part of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 but had not been enforced until Trump’s first term.

Despite government defenses, Judge O’Toole found that the administration did not properly follow rulemaking processes. Changes to the fine assessments overlooked the requirement for public commentary.

Migrant advocates and some lawmakers have challenged these penalties. Senators Alex Padilla and Dick Durbin called for DHS and the Department of Justice to halt enforcing certain penalties on law-abiding immigrants.
