Emmitt Smith Faces Lawsuit Over Alleged $2.5 Million Fraud

Emmitt Smith, a renowned Pro Football Hall of Fame running back, is facing allegations of defrauding a Native American investor out of $2.5 million. This accusation is part of a lawsuit filed in Delaware. The lawsuit reveals that Kituwah LLC, an investment arm of the Band of Cherokee Indians, provided a $2.5 million loan to Smith, his business associate David Mosley, and their real estate company, 413 Solutions, Inc.

According to the legal complaint, Kituwah has received no returns on this loan despite more than two years passing. The company also alleges that the funds intended for a solar project were instead used to repay a different company involved in previous investments in the project. Kituwah LLC has filed for at least $2.5 million in damages, including interest and expenses.

The lawsuit centers on the Project Exodus solar farm. Kituwah anticipated being named a partner, with the expectation that the project would also receive U.S. Department of Energy funding. However, Kituwah asserts it was misled, describing the deal as “essentially, like a Ponzi scheme.” The company claims misleading projections and data led them to make the loan, originally promised to be repaid quickly.

Kituwah’s investigation suggested the funds were diverted to Wilson Holdings, another firm linked to Smith and other defendants in unrelated investments. Kituwah invested significant time and resources in the venture, which has forced them to spend more to recover lost funds.

Emmitt Smith had a stellar NFL career, amassing an all-time record of 18,355 rushing yards and securing three Super Bowl victories with the Dallas Cowboys. He also holds records for rushing touchdowns and rushing first downs. Despite his football success, these latest legal troubles mark a challenging chapter in his post-NFL endeavors.
