Cook County Drops Charges in Firefighter’s Death Case

Cook County prosecutors have dismissed charges against two men accused of igniting a fire in a vacant building to claim fraudulent insurance. This incident led to a blaze that spread to nearby homes, resulting in the death of Chicago firefighter Jermaine Pelt. The decision to drop the charges occurred shortly before the jury trial was set to start.

Anthony Moore, 49, and Nicholas Virgil, 39, faced numerous charges related to the fire and Pelt’s death on April 4, 2023. Virgil was initially charged with murder, aggravated arson, and others, while Moore was charged with wire fraud, insurance fraud, and forgery. Charges against a third suspect, Martez Cristler, 24, were dismissed earlier.

The charges stemmed from a yearlong investigation where prosecutors alleged the men set fire using hand sanitizer bottles and claimed the building was occupied. Prosecutors stated that the fraudulent claim was for a residence filled with furniture and equipment.

Matthew Hendrickson, from the Cook County Public Defender’s Office representing Virgil, noted Virgil’s struggle to prove his innocence for nearly two years. He lost his job after months in jail before being released under electronic monitoring. Hendrickson expressed that the charges dropped reflected a lack of evidence against Virgil.

The Cook County state’s attorney’s office, however, reaffirmed its intention to seek justice for Pelt. Elyssa Cherney, a spokeswoman, declared that prosecutors must be guided by justice, fairness, and law.

In April 2023, Pelt responded to a fire at a frame house on South Wallace Street, where flames consumed the second floor and attic. During efforts to control the fire, Pelt went missing and was later found under debris with his mask dislodged.

Family and colleagues remember Pelt for his devoted service. He was raised and served in West Pullman, the same neighborhood in which he lost his life.
