On September 16, 2024, after experiencing alarming symptoms, Waldorf went to Washington Regional Hospital where she worked as a physical therapist. An ultrasound showed her amniotic sac funneling into her cervix, indicating an imminent miscarriage. Despite the risk of life-threatening infection, her doctors were unable to perform the standard procedure due to Arkansas’ strict abortion laws. The legislation, in effect since the Supreme Court’s reversal of Roe v. Wade in 2022, prohibits abortion if a fetal heartbeat is detected, putting medical professionals in a legal bind.

Legal Barriers to Medical Practice

The presence of a fetal heartbeat left Waldorf in medical limbo. Her care providers and the hospital’s risk management team deferred due to fear of legal repercussions. Despite potential infection from prolonged exposure of her cervix to bacteria, intervention was delayed.

An Inadequate Legal Framework

Arkansas’ laws lack clarity regarding immediate threats posed by conditions like previable preterm premature rupture of membranes (PPROM). While Texas amended its laws to clarify that medical emergencies do not need to be imminent for action, Arkansas did not follow. Cases like Waldorf’s were not isolated, showing that many states operate without coordinated legal or medical guidance to prevent similar tragedies.

A Personal and Systemic Struggle

Waldorf and her family sought solutions, contacting the governor’s office and hiring legal counsel, but with no immediate results. She noted the irony of restrictive abortion laws, intended for those seeking to end pregnancies, impacting those like her, who desperately needed medical intervention to save her life. Her father, a doctor, condemned the situation, emphasizing that preventing sepsis should be a priority in medical emergencies.

The Hardship of Seeking Care Out of State

After days of waiting and the risk of escalating infection, Waldorf received permission to transfer to The University of Kansas Health System in a state with less restrictive abortion laws. At the Kansas hospital, Waldorf underwent induction and delivered her daughter, Bee, short moments before complications nearly claimed her own life. Kansas medical records cited the procedures as crucial for preserving Waldorf’s life. Following her recovery, she reflected on the severe impacts of waiting for care.

A Voice for Change

Having left Washington Regional Hospital, Waldorf opened her own practice, Hive Therapy, honoring her lost daughter. Her experience became central in a lawsuit challenging Arkansas’ abortion ban. Her personal story resonated, prompting public discourse and a deeper understanding of the law’s real-world effects.
