Chemical Incident Spurs Legal Actions Against Aerospace Company

An aerospace company has become the focal point of a chemical emergency that displaced thousands of residents in California over Memorial Day weekend, leading to a new lawsuit. The lawsuit alleges negligence, trespass, and nuisance by the United Kingdom-based GKN Aerospace, claiming failure to uphold safety protocols despite previous regulatory warnings and a record of environmental breaches.

The lawsuit joins several others after a malfunctioning storage tank filled with flammable methyl methacrylate overheated and became compromised. This prompted evacuation orders across various Orange County cities. Fortunately, a crack in the tank reduced pressure, preventing a potentially catastrophic explosion, allowing most evacuees to eventually return home.

State of Emergency Declared

Governor Gavin Newsom declared a state of emergency in Orange County due to the hazardous chemical incident in Garden Grove. The plaintiffs argue their claim of ‘trespass’ is significant, as chemical vapors, odors, and contaminants invaded their community, constituting a property invasion.

The plaintiffs seek unspecified compensation and punitive damages for emotional distress, temporary property use loss, and long-term property value reduction.

Mass Evacuations

Authorities ordered evacuations for approximately 50,000 residents across Anaheim, Buena Park, Cypress, Garden Grove, Stanton, and Westminster. Despite the chemical tank scare, Disneyland remained open as the evacuation zone shrank.

Federal Emergency Declaration

President Donald Trump approved a federal emergency declaration in response to the crisis. The lawsuit claims GKN neglected safety by not implementing adequate inspection or repairs despite known risks related to methyl methacrylate and hazardous materials operations.

The Garden Grove facility, which manufactures aircraft windows and canopies, faced prior regulatory scrutiny regarding environmental compliance. In 2025, a notable settlement over air quality violations resulted in significant penalties.

“Plaintiffs are informed and believe that this prior history placed Defendants on additional notice that their hazardous materials operations required strict compliance, careful monitoring, and conservative safety practices,” the complaint states.

Health Risks and Legal Actions

The Environmental Protection Agency warns that methyl methacrylate exposure can cause respiratory, neurological, and skin, eye, and throat irritation. At least 44 lawsuits have been filed concerning the incident, as reported by the Orange County Register.

In response to the emergency, evacuees were relocated to different shelters after the closure of the Garden Grove Sports and Recreation Center.

Fox News Digital sought comment from GKN. Previously, GKN’s Senior Vice President, Steve Carlin, apologized for the incident, stating the company is dedicated to understanding the situation and supporting those affected.
