Brenda Rivera Estrada, a 30-year-old illegal immigrant, faces charges after a tragic car crash in Arizona. Authorities announced the indictment following toxicology results indicating methamphetamine and marijuana in her system.
Incident Details
The crash occurred on April 12 on Interstate 17 near Cactus Road in Phoenix. Rivera Estrada reportedly lost control of her SUV, causing a crash that resulted in the death of her nine-year-old daughter, who was thrown from the vehicle. Three other children were in the SUV at the time. They sustained minor injuries.
Reports suggest that Rivera Estrada’s daughter was not properly secured and shared a seatbelt with another child. The Arizona Department of Public Safety troopers suspected impairment from marijuana as they detected its smell on the scene. Subsequent tests confirmed the presence of both marijuana and methamphetamine.
Legal Proceedings
Rivera Estrada faces multiple charges: one count of manslaughter, three counts of endangerment, possession or use of dangerous drugs, and possession or use of drug paraphernalia. These charges derive from a grand jury indictment in Maricopa County. She remains in custody at Maricopa County Jail with a cash bond set at $250,000.
The manslaughter charge is a Class Two Dangerous Felony, carrying severe penalties. Her arrest was part of ICE enforcement, responding after Rivera Estrada had initially been released from local custody. Federal immigration authorities detained her while awaiting essential toxicology and crash evidence.
Background and Investigation
Rivera Estrada entered the U.S. via Nogales, Arizona, in February 2009 as a nonimmigrant, permitted for a 30-day stay. She overstayed, violating federal immigration law. Initially, delays in filing charges arose from the need for comprehensive collection of evidence necessary for prosecution.
“We have one chance to get this right,” stated Maricopa County Attorney Rachel Mitchell, referring to complex investigations requiring time to build a solid legal case.
ICE’s Role
Alejandro Almeida, Deputy Field Office Director for ICE Enforcement and Removal Operations in Phoenix, highlighted the significance of Rivera Estrada’s arrest, demonstrating the priority of public safety within the ICE Criminal Alien Program.
ICE continues to emphasize the importance of identifying and detaining individuals violating immigration laws who pose potential public safety threats.
Brenda Rivera Estrada remains in custody as the legal proceedings advance.
