Preliminary Hearing Held for Charlie Kirk Assassination Case

The preliminary hearing for Tyler Robinson, accused of assassinating Charlie Kirk, took place in Provo, Utah. Prosecutors aimed to present compelling evidence, including video testimony from Robinson’s former roommate and text message admissions.

During the hearing, retired FBI agent James Gagliano commented on the Kirk family’s call for transparency, especially with cameras allowed in the courtroom. Prosecutors described Robinson’s lack of marksmanship, mentioning he often missed the target when practicing with the alleged murder weapon. They argued against removing the potential death penalty, emphasizing the risk to others if Robinson fired at Kirk from a rooftop above a large crowd.

Kirk was speaking to an audience in a campus courtyard when he was shot in the neck. The defense argued that the shot came from above and only struck Kirk, as opposed to endangering the crowd. They requested the removal of the aggravating factor before the trial, which would eliminate the death penalty risk if Robinson is convicted.

Evidence, such as shooting targets, was displayed during the proceedings. Prosecutors claimed that Robinson’s actions created a substantial danger to others, impacting their case for capital punishment.

The hearing aimed to assess if there is sufficient probable cause to proceed to trial. Judge Tony Graf Jr. is expected to announce his decision by September 1.

Charlie Kirk, the founder of Turning Point USA, was addressing his audience during his “American Comeback Tour” at Utah Valley University when he was shot. Prosecutors argued for Robinson’s case to be tried, accusing his legal team of ethical violations regarding evidence evaluation.

An image of a bullet casing engraved with “Catch!” and a rifle believed linked to the assassination were presented in court. Surveillance video tracked Robinson across the Utah Valley University campus before the fatal incident. Although Robinson has yet to enter a plea, he is accused of traveling from southern Utah to Orem and shooting Kirk during the September 2025 event, then confessing before surrendering to authorities.
