Trump Criticizes Supreme Court Decisions on Tariffs and Citizenship

President Donald Trump has criticized the U.S. Supreme Court, accusing the justices of making what he describes as “faulty, political, and ridiculous decisions.” He claims these rulings on tariffs and birthright citizenship have cost the United States trillions of dollars. Trump’s comments represent his latest public attack on the high court following significant defeats on two of his major policies.

On Truth Social, Trump expressed his dissatisfaction, stating the court had “lacked the Courage to MAKE AMERICA GREAT AGAIN.” He argued these rulings have damaged the U.S. economy and altered citizenship rules. “Over the last 6 months, with their faulty, political, and ridiculous decisions on TARIFFS and Birthright Citizenship, they have cost the United States of America Trillions of Dollars,” Trump wrote.

The White House has not commented on these statements.

Impact of Recent Court Rulings

The Supreme Court decision in February was a significant legal setback for Trump’s presidency. The court ruled that the International Emergency Economic Powers Act did not grant Trump the authority to impose widespread global tariffs. This forced his administration to reverse the policy and issue refunds to importers.

Around $100 billion in tariff refunds have been paid out as of August, according to documents from customs officials cited by the Financial Times. This constitutes about 60 percent of the $166 billion businesses have paid in tariffs.

In June, the court also upheld a broad interpretation of birthright citizenship, rejecting Trump’s efforts to limit citizenship for children born to parents unlawfully or temporarily present in the U.S. The justices relied on interpretations of the Fourteenth Amendment’s Citizenship Clause. Notably, Conservative Justice Clarence Thomas dissented, expressing skepticism about the interpretation’s durability.

Despite a conservative majority in the court, which includes three Trump appointees—Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett—Trump argued these decisions have adversely affected the economy and immigration.

“It has been a sad chapter in the life and times of America, but we will prevail!” Trump stated.

Continuing the Birthright Citizenship Debate

The Trump administration continues to explore other methods to limit birthright citizenship and address “birth tourism.” A federal judge recently blocked an administration order to restrict birthright citizenship, ruling government restrictions unconstitutional. U.S. District Judge Deborah Boardman cited the Supreme Court’s decision affirming children’s citizenship at birth under the Fourteenth Amendment.

Chief Justice John Roberts authored the June ruling, affirming that birthright citizenship extends to “every free-born person in this land.” Following the unfavorable ruling, the administration has continued to issue directives targeting foreign nationals traveling to give birth and secure U.S. citizenship for their children.

Trump and his allies remain committed to the issue since the court’s decision. New executive orders have been issued addressing birth tourism, and conservative activists discuss maintaining the debate through future litigation, legislation, and judicial nominations.

Uncertain Future

Trump’s remarks reflect his frustration but do not announce any specific new legal actions or policies. Though the administration seeks alternative pathways on tariffs and immigration, Supreme Court decisions continue to constrain Trump’s agenda.

It remains unclear if Trump will pursue additional legislative or legal remedies in response to the court’s rulings. The White House has not indicated any updates on this matter.
