During a preliminary hearing for Tyler Robinson’s trial in Provo, Utah, the testimony of a former roommate provided crucial insights. Lance Twiggs, who received immunity, shared text messages and personal admissions from Robinson, confessing to the assassination of Charlie Kirk.
Prosecutors assert the evidence is sufficient to advance the case to trial. After a five-day preliminary hearing, they submitted a brief to Judge Tony Graf, arguing that probable cause exists on every charge against Robinson.
The brief reads, “This is likely as straightforward a bindover decision as this Court will ever see.” Robinson allegedly told several friends, including Twiggs, that he killed Kirk during an event at Utah Valley University on September 10, 2025, with around 3,000 witnesses present before surrendering to law enforcement.
Robinson’s confessions form only a portion of the evidence presented. Prosecutors highlight DNA testing, surveillance footage, and eyewitness testimony, all supporting the charges. They maintain that probable cause is clearly established for each charge.
Texts between Robinson and Twiggs were also submitted in court. Robinson is said to have confessed, writing, “I had the opportunity to take out Charlie Kirk, and I took it,” and noted that he planned the assassination for over a week. Robinson suggested he would surrender willingly after the crime.
A 28-page memorandum from prosecutors emphasizes evidence like surveillance video that tracks Robinson before and after the shooting at Utah Valley University, DNA linked to the murder weapon, and testimony identifying him as the gunman from a rooftop overlooking Kirk’s event.
Kirk, founder of Turning Point USA, was speaking during his “American Comeback Tour” when he was fatally shot. Prosecutors accuse Robinson of endangering bystanders by firing a high-powered rifle into the crowd intentionally targeting Kirk. They argue the evidence meets the probable-cause standard required for trial.
Judge Graf opted for written arguments following the preliminary hearing. The defense is set to file a counterbrief soon, after which prosecutors will respond before oral arguments on September 1.
Robinson, 23, remains unpleaded and faces charges including aggravated murder. Prosecutors aim for the death penalty on this charge if probable cause is found by Judge Graf.
