Legal Proceedings in Lindsay Clancy Case

Lindsay Clancy’s legal team and Massachusetts prosecutors have agreed to delay defense attorney Kevin Reddington’s motion to investigate the lone holdout juror in her mistrial. Attorney Edward Paltzik informed Fox News that Judge William Sullivan has yet to announce a decision regarding the delay.

The delay agreement is due to the juror’s counsel indicating they lack access to necessary impounded information. Both the District Attorney and Reddington consented to adjourn the investigation. If Judge Sullivan signs an order, much of the case could be adjourned; however, a status conference is still likely.

Lindsay Clancy is scheduled for a status conference following her mistrial, with the court date set for 9 a.m. on Tuesday. This will be her first court appearance since jurors deadlocked on September 4. Local counsel is expected to attend, subject to the judge’s discretion.

The hearing is expected to address Reddington’s motion for an inquiry into the holdout, Michael P. Desronvil, as well as a motion for double jeopardy seeking to dismiss charges instead of holding a retrial.

Michael P. Desronvil was the lone holdout juror in the Lindsay Clancy murder trial, resulting in a mistrial.

Prosecutors also plan to provide updates on their strategies. Reddington requested the court investigate Desronvil, the sole juror who insisted Clancy was guilty of murder in the deaths of her three children, Cora, Dawson, and Callan.

Eleven other jurors concluded Clancy should be found not guilty by reason of mental defect or disease, following an insanity defense claiming she suffered from postpartum psychosis. This defense was pivotal in their decision.

Paltzik raised questions regarding why Reddington did not object to Desronvil as a juror during selection. Reddington had 16 strikes available to remove candidates before the trial.
