Additionally, following his 2024 reelection, he granted clemency to over 1,500 individuals involved in the Capitol riot and other offenses. Notably, at least 97 out of these individuals have been accused of subsequent crimes since January 6, 2021.

The study by Lawfare, a nonprofit legal publication, highlights various individuals who have committed offenses post-clemency:

Ponder’s arrest for sexual assault marks his recidivism after receiving a presidential pardon at the 2020 Republican National Convention.

Andrew Paul Johnson, a January 6 rioter pardoned in 2025, faced child molestation charges and received a life sentence in February 2026. His criminal activities spanned pre and post-pardon periods.

Ryan Nichols, pardoned for a prior assault on police, was charged with threatening a person with a gun outside a church in May 2026.

Others like Zachary Alam, Shane Jason Woods, Theodore Middendorf, and Daniel Tocci faced various serious charges, including home invasion, DUI-related deaths, sexual assault of minors, and possession of child abuse materials.

Notable Offenses by Pardoned Rioters

Individuals involved in the Capitol riots have been linked to severe crimes post-pardon:

  • Emily Hernandez received a 10-year sentence following a fatal DUI crash.
  • Edward Kelley plotted to murder FBI agents and now serves a life sentence.
  • Daniel Ball faced firearm charges post-clemency.
  • Ryan Yates and John Andries were involved in undercover stings and violations of peace orders respectively.
  • Christopher Moynihan faced probation after threatening a political figure.

Implications of Clemency

The cases of recidivism among those who received clemency indicate potential missteps in the executive action process. Lawfare’s study suggests that executive clemency may inadvertently enable further criminal activities, highlighting a need for thorough assessment before granting pardons or clemency.
