In a significant development within the Laguna Beach real estate sector, mogul Mohammad Honarkar has secured a $1.34 billion arbitration award against investor Mahender Makhijani. This follows the dissolution of their joint venture, which saw Honarkar lose control over many properties, including the historic Hotel Laguna.
The Honarkar-Makhijani Dispute
Honarkar, initially facing financial strains during the pandemic, partnered with Makhijani. Their venture soon unraveled, resulting in Honarkar losing possession of his properties. The conflict escalated, notably leading to a public altercation in 2023 at the Hotel Laguna between security teams.
Makhijani, recently arrested by federal authorities for alleged bank fraud involving a $100-million loan default, faces multiple charges. His actions have stirred controversy in the affluent community of Laguna Beach, where properties owned by Honarkar were allegedly taken over by Makhijani and his associates.
Real Estate Scandal Unfolds
Prosecutors describe Makhijani as having built his business on threats and deception. He allegedly used false documents and companies to insulate himself from litigation. A former employee claimed Makhijani also utilized intimidation tactics and inappropriate relationships with bank workers to manipulate outcomes.
The affidavit filed in the U.S. District Court outlines a fraudulent scheme and illegal collection of a $20-million loan using Honarkar’s properties without his knowledge. This loan was part of the joint venture formed in 2021, which led to further disputes.
Legal Proceedings and Arbitration
After uncovering the deceptive activities in March 2023, Honarkar sought legal recourse. An arbitrator ruled highly in his favor, awarding him substantial damages, including compensation for lost properties and legal fees.
The arbitration exposed actions by Makhijani and his associates as fraudulent, finding them liable for breaching agreements and deception. Additionally, Nano Bank, tied to the venture, was found complicit and settled separately with Honarkar.
Future Implications
The $1.34 billion award is yet to be confirmed by an Orange County Superior Court judge. Should it be upheld, Honarkar’s attorney plans to reclaim properties and identify Makhijani’s assets domestically and abroad.
Meanwhile, Hotel Laguna is managed by a receiver with Honarkar hopeful about completing its renovation. Despite years of legal challenges, he remains optimistic about recovering his investments and assets.
