A baby diagnosed with hypoplastic left heart syndrome, a serious heart condition, has undergone surgery following a multi-state legal dispute. The child, named Rumi, was born on Wednesday in Texas. The biological parents, represented by attorney Lee Budner, were involved in legal proceedings with surrogate McKenna West, who refused to terminate the pregnancy despite pressure from the biological parents according to West’s allegations.
The condition, diagnosed in utero, involves the underdevelopment of the heart. The biological parents’ attorney filed a response in Alaska suggesting West initially intended to agree to a termination if tests indicated a fetal abnormality. However, prior to the child’s birth, Texas Attorney General Ken Paxton intervened, requesting a Texas state court to mandate surgery. Paxton, an anti-abortion Republican, alleged the biological parents might deny the baby essential medical care, a claim the parents denied.
The parents’ attorney accused Paxton of turning their personal tragedy into “political theater,” emphasizing they prioritized their baby’s health. Rumi underwent a Norwood procedure on Monday, described as “a complex palliative heart surgery,” by Budner. This procedure is part of a series of three surgeries required within the first years of life for children with hypoplastic left heart syndrome.
“Rumi is now recuperating under the loving care of his parents and his heroic team of doctors, nurses, and medical staff,” Budner stated.
The family aims to maintain privacy during Rumi’s recovery, which remains critical. They have denied refusing to provide care, stating they arranged for treatment in California.
In a court filing, the biological parents acknowledged West’s decision not to proceed with an abortion, respecting her stance. Hypoplastic left heart syndrome, requiring lifelong management, often leads to disabilities, with many affected infants not surviving. The CDC indicates around 925 babies in the U.S. are born with this condition yearly.
Budner added that West is pursuing custody claims described as “baseless” and violating both Alaskan and Californian court orders. The legal team aims to swiftly resolve these claims, focusing on Rumi’s health and safety.
