Arkansas Judge Dismisses Murder Charges Against Sheriff Candidate

A judge in Arkansas has dismissed murder charges against Aaron Spencer, a local sheriff candidate and Army veteran. Spencer was accused of fatally shooting Michael Fosler, 67, who allegedly sexually assaulted Spencer’s teenage daughter.

The incident occurred in October 2024 in Lonoke County. Prosecutors claimed Spencer found Fosler alone with his daughter in Fosler’s pickup truck late at night. Spencer reportedly forced the truck off the road before calling 911 to report the shooting.

Special Circuit Court Judge Ralph Wilson Jr. dismissed the charges, citing mishandling of evidence by law enforcement. He noted that the loss of dash-camera and SD card evidence was significant enough to warrant dismissal. The judge described the mishandling as egregious, affecting Spencer’s right to a fair trial.

The judge stated that dismissal is an “extraordinary and extreme remedy” in any criminal case.

According to court documents, the defense argued that the SD card could contain crucial footage of the altercation, which was lost. There was no documentation about the loss, affecting Spencer’s defense.

Fosler had been charged with several sexual offenses against Spencer’s daughter and was out on bond at the time of the shooting. Spencer pleaded not guilty to murder charges and was set for trial on June 22.

After his arrest, Spencer announced his candidacy for sheriff. He won the Republican primary, pledging to reform the county’s law enforcement. He highlighted issues in law enforcement he observed during his legal battles.
