Appeals Court Overturns Convictions in Whitmer Kidnapping Plot

In a key legal development, a state appeals court on Monday overturned the convictions of two men involved in a 2020 conspiracy targeting Michigan Governor Gretchen Whitmer. Both men, Pete Musico and Paul Bellar, had faced charges of providing material support for terrorism. They, alongside co-defendant Joe Morrison, were accused of playing secondary roles in this plot.

Morrison’s conviction was annulled in June based on a precedent-setting decision. The Michigan Court of Appeals, bound by this precedent, extended similar relief to Musico and Bellar. The court cited technical reasons for overturning the convictions, emphasizing that kidnapping does not qualify as a fundamental violent felony under Michigan’s terrorism statute.

Attorney General Dana Nessel criticized the ruling, referring to it as ‘linguistic gymnastics’ and indicated plans to petition the Michigan Supreme Court for a review of the cases.

Morrison, Musico, and Bellar were not directly implicated in the planned abduction of Governor Whitmer. Notably, Bellar had relocated out of Michigan weeks before the FBI made arrests in October 2020. Morrison and Musico also claimed disassociation from key figures in the conspiracy.

Despite this, they were affiliated with a paramilitary group that previously engaged in training exercises with Adam Fox. Fox, regarded as the leader, received a 16-year prison sentence for conspiracy following prosecution in federal court.

The plot allegedly involved abducting Whitmer from her vacation residence just prior to the 2020 presidential election. Prosecutors claimed the conspirators were enraged by stringent COVID-19 measures implemented by Whitmer and other officials, as well as perceived threats to their gun rights.

Governor Whitmer, a Democrat, remained unharmed throughout. The scheme was thwarted thanks to undercover FBI agents and informants who had penetrated Fox’s circle long before.

This investigation’s outcomes were mixed across state and federal levels, with five of the 14 defendants acquitted during trials.
