Controversial Fund Creation Raises Legal Concerns

The establishment of a $1.8 billion fund by the Trump administration has sparked controversy over its legality and adherence to established policies. This fund aims to compensate individuals who allege mistreatment by the federal government. Legal experts argue it violates longstanding Justice Department standards and a policy directive from last year.

Pam Bondi, who became attorney general in February 2025, signed a directive prohibiting the creation of such funds. This decision contradicts the administration’s initiative set up this week.

During a Senate hearing, Acting Attorney General Todd Blanche acknowledged the fund’s unusual nature. He defended it as being consistent with past settlements. However, Justice Department veterans express skepticism, particularly regarding immunity provisions for President Trump, his sons Eric and Donald Trump Jr., and the Trump Organization. Critics find the idea of granting blanket immunity rare and concerning, with Jennifer Ricketts, a former branch director, calling it ‘blatantly corrupt’.

The fund also seems to conflict with a policy set by former Attorney General Bondi. Last year, her directive generally forbade payouts to groups not directly involved in lawsuits. Critics argue that the new fund potentially offers unwarranted financial benefits to individuals who have not filed claims against the government.

The agreement, made without judicial oversight, could lead to significant financial awards for those who have not pursued legal action. The Justice Department has not provided comment on these concerns.
