GOP Lawmakers Question FDA Over Abortion Pill Safety Review

2 hours ago 0

Congressional Republicans have raised concerns over the Food and Drug Administration’s (FDA) recent announcement regarding the safety review timeline of mifepristone, an abortion pill. The FDA disclosed that the results of this review would be available by March.

The FDA’s court filing last week indicated that the agency plans to complete its safety assessment by mid-December. The findings will be published by March 2027, after which the FDA will decide if any new restrictions or changes to the drug’s use are necessary. Currently, the combination of mifepristone and misoprostol is the most prevalent method of abortion in the U.S.

Republican Concerns

Senator Josh Hawley (R-Mo.) expressed worries about the sufficiency of the FDA’s data review concerning potential adverse effects. In a letter, he requested that acting FDA Commissioner Kyle Diamantas ensure the review includes post-2023 data after mifepristone’s wider accessibility under the Biden administration. This accessibility includes distribution by mail.

In April 2021, the FDA suspended its in-person dispensing requirement for mifepristone amid the COVID-19 health crisis. Then, in January 2023, the agency amended the mifepristone REMS (Risk Evaluation and Mitigation Strategy) to permit certified retail pharmacies to distribute the drug.

Representative Chip Roy (R-Texas) issued a stronger letter demanding immediate release of the study results upon completion, rather than waiting until March. He urged the FDA to declare in advance if the in-person dispensing requirement will be reinstated. Roy further threatened to propose an amendment to the FDA’s appropriations bill, blocking the use of funds to implement the regulation allowing mail and pharmacy distribution of mifepristone.

House Republicans cannot be expected to continue funding the implementation of the January 2023 REMS modifications indefinitely while FDA repeatedly extends its review without committing to corrective action.

Roy highlights the importance of completing the review without using this process as an excuse for prolonged delay.
