Justice Department Withdraws Subpoenas for Reporters in Leak Investigations

The Justice Department has retracted subpoenas initially aimed at compelling reporters from The Wall Street Journal and The Washington Post to testify before a federal grand jury in Virginia. These subpoenas were part of the Trump administration’s intensified actions to identify individuals leaking details about its internal decision-making processes.

The subpoenas sought testimony from journalists as the department pursued criminal investigations into the leaking of national security information. However, the news organizations contested these moves in sealed filings, leading the Justice Department to step back from its demands.

The attempt to subpoena the reporters marked a notable increase in efforts under the Trump administration to involve journalists in criminal probes related to classified information leaks. Todd Blanche, the acting attorney general nominated by President Trump for a permanent role, supported the use of subpoenas, asserting in the previous month: “Any witness, whether a reporter or otherwise, who has information about these criminals should not be surprised if they receive a subpoena about the illegal leaking of classified material.”

Typically, leak investigations into the release of classified information are not uncommon, but targeting journalists with subpoenas is rare. Those advocating for press freedom argue that such legal actions encroach upon First Amendment rights and could deter essential reporting efforts.
