The Department of Homeland Security (DHS) has reported that an illegal immigrant, Moises Domingo Rico Rosales, from Nicaragua, was involved in two criminal incidents at Wakefield Park in Annandale, Virginia. He faced charges of abduction with intent to defile and indecent exposure. Rico Rosales was earlier arrested on felony drug trafficking charges in 2024 but released after local authorities did not cooperate with federal immigration detainers.
Previous Arrest and Release
Rico Rosales entered the United States illegally in Arizona during 2022, under the Biden administration, according to DHS. In 2024, he was arrested in Fairfax County but released after a judicial decision. This resulted from the refusal of Fairfax County’s sanctuary policies to cooperate with Immigration and Customs Enforcement (ICE). These local policies led to the dismissal of drug charges against him by the Fairfax County Commonwealth’s Attorney, associated with Steve Descano’s office.
New Charges and ICE Detainers
The recent charges against Rico Rosales spotlight ongoing disputes over sanctuary policies in Northern Virginia. DHS has emphasized the need for stricter cooperation with ICE, especially in the wake of other crimes, like the stabbing of Stephanie Minter by Abdul Jalloh. The Fairfax County Sheriff’s Office stated there was no judicial warrant accompanying ICE requests, which prevented holding Rico Rosales post-release.
“This criminal illegal alien exposed himself to one woman in a park and then attempted to abduct another woman the same day,” said Acting Assistant Secretary of DHS Lauren Bis.
Fairfax County asserts its policy not to detain individuals solely based on ICE detainers unless paired with a judicial order. The sheriff’s office has denied obstructing ICE if proper documentation is provided.

The involvement of political figures like Governor Abigail Spanberger has become prominent.
