Attorneys representing former U.S. Olympian David Hearn have requested federal oversight on the Justice Department’s handling of a felony case against him. They are urging inspectors general from the DOJ and Interior Department to investigate what they consider a flawed process that led to wrongful charges of property destruction against Hearn.
The case, now permanently dismissed, involved accusations that Hearn damaged the Lincoln Memorial Reflecting Pool. However, critical evidence supposedly overlooked by investigators proved that the accusations were unfounded. The dismissal by D.C. Superior Court Judge Todd Edelman cited the rapidity of the indictment process, barring the DOJ from further attempts to charge Hearn.
The attorneys argue the charges were a result of undue political pressure, specifically from President Trump. They point out that Attorney Jeanine Pirro’s office might be inclined to pursue the case again due to such pressure. The lawyers’ call for an investigation aims to uncover facts and hold accountable those responsible for the inadequate case against Hearn. They emphasize the importance of collecting related documents and conducting witness interviews.
Hearn, aged 67, was originally charged in June for allegedly damaging the Reflecting Pool’s liner. This charge was later dropped when evidence indicated that the damages were due to faults in the pool’s renovation rather than Hearn’s actions. The project was expedited to prepare for America’s 250th birthday celebrations. Hearn’s legal team argues that the exonerating evidence was available long before prosecutors decided to dismiss the case.
The letter from Hearn’s attorneys highlights the indictment as being driven by haste and political influence, rather than solid investigative work.
