Louisiana is urging the Food and Drug Administration (F.D.A.) to restrict access to medication abortion, which could influence upcoming elections. The issue arises amid other political challenges for Republicans, such as an unpopular war, rising inflation, and declining approval ratings for President Trump.
Even four years after the overturn of Roe v. Wade, which established a nationwide right to abortion, availability and numbers have remained steady. This stability is largely due to abortion medication such as mifepristone, still accessible by mail as per a Biden-era F.D.A. decision.
However, a Louisiana lawsuit threatens this access, and the Trump administration has been notably silent. The case has recently reached the Supreme Court after a federal appeals court prohibited prescribing mifepristone via telemedicine or mail. The Supreme Court has intervened twice, maintaining telemedicine and mail access during ongoing litigation.
Despite these developments, President Trump maintains silence, labeling himself “the most pro-life president in history.” His Justice Department refrained from submitting a brief to the Supreme Court, a departure from normative procedure.
“That they’re the folks who are most directly affected by the litigation and they’re not filing anything — that is shocking,” said Samuel Bagenstos, former General Counsel for the Department of Health and Human Services under the Biden administration.
As the legal battle continues, the political implications for the Trump administration remain uncertain, with potential consequences for the upcoming midterm elections.
