A federal judge has issued a warning to Donald Trump regarding the president’s $10 billion lawsuit against the BBC. The case stands at risk of dismissal unless Trump’s legal team presents more relevant documents or evidence related to their search for them.
Trump’s legal team was given until October 21 to confirm the accuracy of its written answers and to provide all relevant, undisputed documents. This is part of the discovery phase in Trump’s claim that the BBC defamed him by editing two different sections of a speech he delivered before the U.S. Capitol riot in 2021. Although the BBC has apologized for the editing, the organization denies any acts of defamation.
Magistrate Judge Enjolique A. Lett voiced concerns about the response from Trump’s legal team, stating that it comprised only twenty documents. These documents were either previously produced by the defendant or sourced from the internet shortly before the production date.
Lett pointed out that Trump’s team admitted they had not generated a log that identifies documents withheld due to privilege. “Given the nature of the requests, the paucity of the production, and the steps counsel undertook to ensure that all responsive documents were collected, the Court has concerns about whether an adequate search for all responsive documentation occurred,” Lett stated.
Lett ordered Trump’s team to submit a privilege log by November 5 and any remaining undisputed responsive documents by November 23. She warned that failure to comply with this order could lead to sanctions, including dismissal of the case for failure to prosecute.
This case is a developing story, with updates expected in the near future.
