Jury Deadlock in Lindsay Clancy’s Trial Raises Questions

On Tuesday, the jury in Lindsay Clancy’s trial informed the judge of a deadlock in their deliberations. This indicates an inability to reach a unanimous verdict. In response, Judge William Sullivan instructed the jurors to continue deliberating. They persisted until approximately 3:30 p.m. before leaving for the day without a decision.

Recent High-Profile Hung Juries

The situation echoes several recent high-profile cases in Massachusetts with hung juries. Notably, the trials of Karen Read in 2024 and Emanuel Lopes in 2023 and 2024 demonstrate similar issues. Lopes was accused of murdering Weymouth Police Sgt. Michael Chesna in 2018. His initial trial in 2023 resulted in a mistrial due to a deadlocked jury. A subsequent trial in 2024 also faced a deadlock, with the jury reporting it three times before finally reaching a unanimous guilty verdict after six days and 32 hours of deliberations.

Karen Read’s trial in 2024 also ended with a hung jury. After deliberating for five days and 27 hours, jurors signaled a deadlock three times, leading to a mistrial. Read was acquitted a year later in a second trial.

Understanding the “Tuey-Rodriguez” Instruction

In cases like these, judges often use a “dynamite” charge to motivate jurors toward a verdict. In Massachusetts, this is known as the “Tuey-Rodriguez” instruction, stemming from a 1973 case. This law allows judges to send jurors back to deliberate up to two times, with further chances if legal clarifications are requested. After the second report of a deadlock, judges consult with attorneys and usually read the “Tuey-Rodriguez” charge.
