Avenal Officials Step Down After Court Ruling on Recall

The ruling came from Judge Jennifer Giuliani of Kings County Superior Court. She declared that the four officials, who have been serving since the April recall, were not legally occupying their positions. The election results had been certified on May 28, but the officials remained in office, contesting the legitimacy of the recall process.

Judge Giuliani stated, “The ultimate issue is not close. The court must uphold the will of the electorate, and Avenal voters have spoken decisively.” While acknowledging procedural irregularities in the election, Giuliani emphasized that these did not impact the results or the merits of the recall.

The recalled mayor, Alvaro Preciado, has the opportunity to re-enter the political field by placing his name on the ballot for the city’s upcoming general election scheduled for November 3. We also believe today confirms that the city was right to bring these questions before a court rather than simply surrender its municipal authority.”
