A judge in Los Angeles has ruled there is enough evidence to proceed with a trial against singer David Burke, known as D4vd. He faces charges of murder, continuous sexual abuse of a minor under 14, and illegal mutilation of human remains. The victim, Celeste Rivas Hernandez, was 14 years old. Prosecutors allege that she threatened to expose their relationship and damage Burke’s career, leading to the tragic events.
Judge Charlaine Olmedo concluded that the evidence presented during a five-day preliminary hearing was substantial enough for a trial. “The prosecution has met its burden on all charges,” Olmedo stated. Burke, aged 21, has pleaded not guilty and remains in custody without bail.
Burke’s defense declined to comment outside the court. However, Judge Olmedo emphasized that the standard of probable cause at a preliminary hearing is significantly lower than that required at trial. Despite this, prosecutors maintained that their evidence was overwhelming. Deputy District Attorney Beth Silverman remarked, “Based on the overwhelming evidence provided, all accusations exceed the required standard.” Burke is scheduled for arraignment on August 31.
Prosecutors recounted events on the night of April 23, 2025. Celeste’s phone fell silent permanently after exchanges with Burke, right before she entered her home. They allege that Burke fatally stabbed her moments after she sent her last message stating, “I am almost there; open the door if you are home.” This occurred after a heated exchange regarding Burke’s relationship with another woman.
Allegations of Ongoing Abuse
The prosecution accuses Burke of beginning a relationship with Rivas Hernandez when she was 11 and continuing abuse when she turned 13. They assert he ordered chainsaws and kiddie pools used to dismember her body in his garage, where police found evidence of his DNA mixed with blood stains.
Rivas Hernandez’s decomposed body was later discovered in a Tesla registered to Burke, four months after the incident. Prosecutors claim video surveillance shows Burke being the last person to drive the vehicle.
Defense’s Argument
The defense insists that evidence for the murder charge is insufficient. Defense attorney Marilyn Bednarski contends there is no proof Burke intended to kill Rivas Hernandez. The defense suggests that the forensic evidence does not conclusively indicate murder. They argue that communications between Burke and Rivas Hernandez do not reveal any intent for violence.
The defense argues that Rivas Hernandez had expressed anger and sent threats to Burke, showing no indication of her intending to involve the authorities. They allege that her demands to visit Burke were persistent despite his reluctance.

Detective testimony revealed explicit photos and text exchanges indicating sexual abuse, with Rivas Hernandez undergoing an abortion at 13, allegedly after becoming pregnant by Burke. These graphic discoveries caused emotional distress to her parents during court proceedings.
