The New York City Council has announced an investigation into the marketing practices of four prediction markets. These companies, Gemini Titan, Kalshi, Polymarket, and Coinbase, face allegations of engaging in deceptive advertising. While Gemini Titan, Kalshi, and Polymarket are based in New York, Coinbase operates out of Texas.
The investigation aims to scrutinize how these platforms promote betting on sports, politics, culture, and various other events. Julie Menin, the New York City Council Speaker, expressed concerns about the potential impact on New Yorkers, particularly younger consumers.
“Prediction markets aggressively entice consumers to bet and wager on sports, politics, culture, weather, and pretty much anything. We refuse to let New Yorkers, especially our young people, become collateral damage,” Menin said.
Following a Wall Street Journal investigation in June revealing that Polymarket paid content creators to misrepresent earnings from trades, Menin sought further information about their marketing in New York. Consequently, Polymarket committed to auditing its promotional content. Additionally, the New York City Council is probing allegations against Polymarket for misleading marketing targeted at young adults.
Polymarket has welcomed the opportunity to engage with the council. Meanwhile, the other targeted companies, Gemini Titan, Kalshi, and Coinbase, have yet to comment.
This investigation highlights the ongoing jurisdictional disputes between state and federal authorities over prediction markets. States including New York, led by Attorney General Letitia James, have filed lawsuits asserting illegal gambling operations against these platforms. They argue that these businesses operate in defiance of state laws. On the other hand, the Commodity Futures Trading Commission (CFTC) claims it has exclusive regulatory rights over derivative markets, including prediction markets.
The CFTC’s involvement raises questions about whether its jurisdiction extends to sports betting, which accounts for a significant portion of the trading activities within these markets.
