Father Sues School District Over Bathroom Access Policies

A father from North Carolina has filed a lawsuit against a school district after failing to get answers about whether biological males can use the same bathrooms as his fourth-grade daughter. Brandon Matthews, whose children attend Mount Pleasant Elementary and High School, raised concerns regarding the school’s bathroom policy in May.

Matthews requested the principals to inform him if any opposite biological sex students could access restrooms or locker rooms used by his children. Despite assurances from the principals, Matthews remains without concrete answers.

“Brandon Matthews does not currently know whether a male is using his fourth-grade daughter’s bathroom,” stated Nicholas Barry, Matthews’ attorney.

A lawsuit against Cabarrus County Schools seeks clarity on their bathroom policies. Matthews expressed his concerns during a school board meeting, urging for gender-separated bathrooms to ensure privacy and comfort for students.

Matthews filed the lawsuit after repeated attempts to secure clear policy information. His attorney argues that this lack of transparency hinders Matthews from making informed choices for his children.

The legal action takes place as America First Legal Foundation supports Matthews in his quest for disclosure. The case seeks a preliminary injunction demanding the district to reveal its policies and provide notice if opposite-sex individuals can access facilities used by his children.

Matthews, a Christian, adheres to beliefs that sex is immutable. He wants assurance his children won’t need to use restrooms with opposite-sex individuals, consistent with religious principles.

This lawsuit is not the first involving Cabarrus County Schools, as previous allegations regarding bathroom access with biological males have arisen at different schools.
