ICC Prosecutor Karim Khan Removed Amid Allegations

The chief prosecutor of the International Criminal Court (ICC), Karim Khan, has been removed from his position following allegations of sexual misconduct. Khan, a British barrister, was removed nearly two years after these allegations came to light, amid a broader context of challenges faced by the ICC.

The decision was made by the ICC’s 125-member states, who voted largely in favor of removing Khan for serious misconduct and serious breach of duty. This decision underscores the court’s commitment to maintaining the highest standards and ensuring a secure working environment, as emphasized by Liz Evenson, the international justice director at Human Rights Watch.

Khan, aged 56, was accused of having a sexual relationship with a female aide and allegedly attempted to prevent her from pursuing her claims. Despite Khan’s consistent denials, these accusations were brought to light through reports by the Associated Press (AP).

The ICC, now faced with the need to appoint a new prosecutor, is navigating a hostile environment. The United States, under Secretary of State Marco Rubio, has initiated a campaign to undermine the ICC, citing threats to U.S. sovereignty. This includes pressuring member states to leave the ICC, imposing sanctions on those working with the court, and prohibiting ICC staff from entering the U.S.

Following the vote for Khan’s removal, Venezuela announced its withdrawal from the ICC. The country’s foreign affairs minister, Félix Plasencia, argued that the court shows a geographical bias towards African and Latin American nations, disadvantaging the Global South. This decision came after the ICC dropped an investigation into whether U.S. sanctions against Venezuela amounted to crimes against humanity.

Khan’s lawyers have criticized the removal process, citing a lack of opportunity for Khan to speak in his defense and claiming that procedural regulations were altered unfairly. Attorney Tayab Ali has stated that Khan’s legal team will challenge the removal through legal channels.

Trump’s administration had previously sanctioned Khan and other ICC staff in response to the court’s arrest warrants for Israeli officials, including Prime Minister Benjamin Netanyahu. This situation has intertwined with the Gaza investigation, illustrating the political complexities involved.

Despite Khan’s removal, the pending arrest warrants for Netanyahu and former Defense Minister Yoav Gallant will stand, as only ICC judges can rescind them.
