Maricopa County Resolves Election Administration Dispute

Maricopa County, Arizona, a focal point of election-related controversies, has reached a resolution regarding its election administration duties. The county has been a center of election denial and conspiracy discussions since President Joseph R. Biden Jr. won the state in 2020.

Recently, the Republican leadership in Arizona’s largest county concluded an agreement addressing the administration of its elections. This marked the end of a yearlong struggle for control that risked undermining the democratic process in this politically pivotal area.

By law, Arizona allocates election responsibilities between a county’s board of supervisors and its recorder. In Maricopa County, which includes Phoenix, disputes arose between these two entities over specific duties.

The county recorder, an ally of former President Trump and someone who has not confirmed the fairness of the 2020 and 2022 elections, filed a lawsuit against the Republican-led board. The recorder claimed that the board had unlawfully taken control of certain election responsibilities, funding, and information technology systems designated for his office. Conversely, the board accused the recorder, Justin Heap, of attempting to disrupt the county’s election process.

The legal settlement was reached after lengthy negotiations and sanctioned during an emergency board meeting. The State Supreme Court also intervened before the final agreement was made. The settlement specifies which party oversees various election functions. The board will generally manage Election Day operations and tabulation, while Mr. Heap’s office will handle voter registration and early voting.

The board has allocated up to $15 million for the recorder’s new information technology system and committed to financing numerous new staff positions.

“This settlement agreement now provides an off-ramp from this highway to hell that we’ve been on,” Tom Galvin, one of the board’s four Republican supervisors, remarked at the meeting. “It’s not perfect, but overall it provides certainty for how we move forward in running elections.”
