Recent Change in Kentucky’s Senate Vacancy Laws

In 2024, Kentucky made a vital change to its Senate vacancy laws, removing the governor’s power to appoint a replacement senator. Instead, any vacancy must be filled through a special election. This change is applicable if a vacancy arises before McConnell’s current term ends in January 2027.

Under House Bill 622, which repealed KRS 63.200, the governor must issue a proclamation calling for an election to fill the seat, and the winner would complete the unexpired term. This law also establishes deadlines for notices and candidate filings related to the election. Notably, the law eliminated the governor’s authority to appoint an interim senator, a system many states still use.

Questions About McConnell’s Health

McConnell remains hospitalized after a reported medical emergency, causing widespread concern. His office confirmed the hospitalization but provided few details. On Thursday, his office communicated that McConnell is grateful for the support and continues to improve, working with his staff on both Kentucky and Senate matters while the Senate is out of session.

McConnell announced in 2025 that he would not seek reelection, and voters are set to choose his successor in November 2026. Until then, he remains a sitting senator.

Elaine Chao’s Trip and Public Attention

The situation has also drawn attention to McConnell’s wife, former Transportation Secretary Elaine Chao. Reports showed Chao involved in meetings in China shortly after McConnell’s medical emergency. The image of Chao meeting with Chinese Vice President Han Zheng in Beijing appeared, with Zheng reportedly advocating for strengthened China-U.S. relations.

What the Law Specifies

The revised law spells out that Senate vacancies must be filled via election, detailing filing and notice requirements. However, it lacks specifics on handling a vacancy late in an election year while a Senate race is already scheduled, which is relevant since McConnell’s seat is contested in the 2026 election. Voters will elect someone new for a six-year term in November 2026, regardless of McConnell completing his current term.

Unresolved Issues and McConnell’s Retirement

Given McConnell’s retirement announcement, the unresolved issue is not about his successor eventually but on handling a vacancy before January 2027 under Kentucky’s revised law.
